Terms of Use

1. Agreement

These Terms of Use (“Terms”) are a contract between you and the operator of CompareNow (“CompareNow”, “we”, “us”) for access to https://comparenow.in and related pages, search, compare, alerts and blog (the “Service”).

They should be read with our Privacy Policy. If you use the Service on behalf of an organisation, you confirm you have authority to bind it.

2. The service

CompareNow provides:

• product search and catalogue browsing across Indian stores we track;
• offer lists with prices, store names and outbound links;
• optional side-by-side comparison;
• optional price-history snapshots and drop alerts;
• editorial articles on the blog.

Features may change, pause or close without notice. We may add or remove stores, categories or products at any time. We do not promise uninterrupted or error-free operation.

3. We are not the seller

When you click through to a store:

• your purchase contract is solely with that store (and, if applicable, its marketplace seller);
• shipping, GST invoice, returns, replacements and customer care are the store’s responsibility;
• the store’s own terms, privacy policy and refund rules apply to that purchase.

If a delivery fails, a price changes at checkout, or a product is counterfeit or damaged, you must contact the store — we cannot cancel or refund a merchant order.

4. Affiliate disclosure

Many outbound “buy” links are affiliate links. If you click and later buy, we may earn a commission from the store or its affiliate network. You pay the same price you would have paid by visiting the store directly (unless the store itself runs a different promotion on another landing page).

Commission does not decide the “best price” badge. That badge is based on the lowest in-stock (or listed) price we currently have for that product, subject to matching errors. If we introduce paid placements, they will be labelled as advertising or sponsored.

5. Prices, availability and matching

Prices, discounts, MRP, stock and seller names are copied from merchant feeds, public pages or partners. They can be wrong, stale or incomplete. A store may change the price after you leave CompareNow. Taxes, shipping, exchange offers and bank discounts shown on the store may not appear in our figure.

We try to attach offers to the correct product. Listings can be mismatched (wrong colour, storage, refurbished vs new, bundle vs bare unit). Always read the store title and specifications before you pay.

Price history is a record of snapshots we stored. It is not a certified appraisal and may have gaps. Alerts are a convenience; they may fail, delay or fire on a rematched product. Do not rely on an alert as the only way you will catch a deal.

6. Accounts and alerts

Some features (saved alerts, dashboard) need an account. You must provide accurate information, keep your password secret, and tell us if you think the account was misused. You are responsible for activity under your login.

We may refuse, suspend or delete an account if we reasonably believe these Terms were broken, the account is automated abuse, or we are required to by law. You may close your account by contacting hello@comparenow.in.

Email alerts can land in spam. We are not liable if you miss a notification.

7. Acceptable use

You agree not to:

• scrape, crawl or bulk-download the Service in a way that overloads our servers or copies the catalogue to run a competing site, except as allowed by a written licence or robots.txt;
• bypass rate limits, authentication or security controls;
• introduce malware, or attempt to access other users’ accounts or our admin systems;
• use the Service to send spam or to mislead others about prices;
• misrepresent an affiliation with CompareNow or a store;
• use the Service for any unlawful purpose under Indian law.

Automated access for indexing by major search engines is welcome if it respects robots.txt. Other bots need our prior written consent.

8. Intellectual property

The CompareNow name, logo, layout, original text, and our compiled catalogue structure are owned by us or our licensors. You may not copy the site design or republish our pages as your own product.

Product names, images, trademarks and logos of Amazon, Flipkart and other brands belong to their owners. They appear only to identify goods and stores. Product photos are typically provided by merchants or public listings; if you are a rights owner and want an image taken down, email hello@comparenow.in with a URL and proof of rights.

You may share a link to a CompareNow page. You may not frame the Service or use our marks in a way that suggests we endorse you, without permission.

9. Third-party sites and content

Outbound links, store widgets, blog embeds and social posts are provided for convenience. We do not control third-party content and are not responsible for their accuracy, legality or privacy practices. Your use of those sites is at your own risk.

10. Disclaimers

THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. To the fullest extent permitted by Indian law, we disclaim all warranties — express or implied — including merchantability, fitness for a particular purpose, title and non-infringement.

In particular, we do not warrant that:

• any displayed price is the lowest available in India, or will still be valid at checkout;
• a product is authentic, safe, or suitable for you;
• search results are complete or that a store we omit is more expensive;
• the Service will be uninterrupted, timely or free of harmful components.

Nothing in these Terms limits rights that cannot be excluded under the Consumer Protection Act, 2019 or other mandatory Indian law — those rights sit against the seller of the goods in most cases, not against CompareNow as a comparison publisher.

11. Limitation of liability

To the fullest extent permitted by law, CompareNow and its operators, officers and contractors will not be liable for any indirect, incidental, special, consequential or punitive loss, or for lost profits, lost savings, or data loss, arising from the Service or from a purchase you make on a third-party store.

Our total liability for claims arising out of the Service in any twelve-month period is limited to the greater of (a) the commissions we actually received that are attributable to your clicks in that period, and (b) INR 1,000. This cap does not apply to liability that Indian law says cannot be limited (for example, fraud or wilful misconduct).

12. Indemnity

You agree to indemnify and hold CompareNow harmless from claims, damages and reasonable legal fees arising from your misuse of the Service, your breach of these Terms, or your violation of any law or third-party right — except to the extent a claim is caused by our wilful misconduct.

13. Governing law and disputes

These Terms are governed by the laws of India. Courts of competent jurisdiction in India shall have exclusive jurisdiction, subject to any mandatory venue rule that applies to you as a consumer.

Before filing a claim, please email hello@comparenow.in so we can try to resolve it. Nothing here stops you from approaching a consumer commission against a store that sold you goods.

14. Changes and contact

We may update these Terms by posting a new version on this page and changing the “Last updated” date. If a change is material, we will try to give reasonable notice on the site or by email. If you continue to use the Service after the new Terms apply, you accept them. If you do not, stop using the Service and close your account.
